Red Flags Dating (“RFD”) is a dating app that promotes transparency and trust. Therefore, we are dedicated to helping you make meaningful connections while prioritizing your privacy and data protection.

Whilst you’re enjoying the RFD mobile application (including the desktop version) (“App”), our websites and microsites or using our digital products and services (such as our competitions or surveys) (together, referred to in this Policy as our “Sites”), we collect some information about you.

The RFD Privacy Policy (“Privacy Policy”) outlines how we collect, use, share, and protect your personal information when you use our services. Please read the Privacy Policy carefully. By using the App and Sites, you agree to the terms described in this Policy.

The App and Sites are operated by the “RFD Group” (also referred to in this policy as “we” or “us”), which includes Luceat Lux Vestra HoldCo Pty Ltd (ACN 668 999 559) and Luceat Lux Vestra OpCo Pty Ltd (ACN 34 669 024 748) and other related bodies corporate, all of which are controllers of personal information collected and processed through the App and Sites.

We are bound by the Australian Privacy Principles contained in the Privacy Act.

1. Information We Collect

If you have chosen to include sensitive information, such as your political opinions, the processing of such information is based on your voluntary and explicit consent.

Please be aware that the information you share on your profile may be visible to other select users.

1.4. Location Information:

If you have given consent, RFD can access your device's location data. You can control this access in your device settings.

This location information helps RFD to personalise your experience on the app and make it easier to find other users near you.

If you choose to make in-app purchases or subscribe to premium services, we may collect payment information such as credit card details, billing address, and transaction history.

1.6. Third-Party Integrations:

When you link your RFD account with third-party services or social media platforms, we may collect data from those accounts but only as permitted by those platforms (and as agreed by you and those platforms).

When you visit our Sites or when you use our App, we may collect personal data from you automatically by using cookies or similar technologies. 2. How We Use Your Information

2.1. Matchmaking:

We may use the information you provide to match you with potential partners based on your preferences, location, interests, and other such compatibility factors.

We will never share private personal information with other users.

2.2. Communication:

To facilitate communication between users, we use your data to send and receive messages, notifications, and updates.

We may also contact you to seek your consent in partaking in our research surveys, testimonial requests, or marketing campaigns.

2.3. Improving Services:

We analyze usage patterns and feedback to enhance the app's functionality, usability, and user experience. This is done to optimise your experience on the app.

3.1. Other Users:

Certain information, such as your name, age, and photos, is visible to other users on RFD as part of your profile. Be cautious about sharing sensitive information with other users.

3.2. Service Providers:

We may share your information with trusted third-party service providers who help us with functions like data hosting, billing services, authentication/KYC services, IT services, customer support, and marketing.

Encouraging our users to be authentic and bold requires a safe environment so we carry out due diligence on all trusted third-party service providers to confirm they have adequate data protection and information security measures in place. We provide trusted third-party service providers with only the necessary information required to perform their services.

3.3. Legal Compliance:

We may disclose your information when required by law, legal processes, or to protect our rights, privacy, and security.

3.4. Business Transactions:

In the event of a merger, sale, or acquisition, your information may be transferred to the acquiring entity.

4. Your Privacy Choices

4.1. Profile Control:

You can review and update your profile information and privacy settings within the app.

You can modify “device permissions” accordingly for specific types of device data and notifications (e.g. phone contacts, pictures, location services, push notifications). These changes will affect the corresponding functionality, service, and experience as a user.

You can also uninstall the app using the standard protocol on your device. However, uninstallation will not close your account.

You can close your account by using the corresponding functionality directly within the app.

You have rights associated with your privacy. Please contact us directly as set out in paragraph 8 (Contact Information) to exercise your rights, including requesting a copy of the information we collect about you or the correction or deletion of that information.

4.2. Location Services:

You can manage location services in your device settings and within the app.

4.3. Marketing Communications:

You can opt out of marketing communications by adjusting your notification settings or contacting us directly.

5. Security Measures

Our mission is to create the safest platform for online dating. We therefore understand the important of taking all appropriate security measures to help protect your information against loss, misuse and unauthorised access, or disclosure.

We use reasonable security measures to protect your data, including encryption, access controls, and regular security audits.

The nature of internet transmission means that nothing is ever completely 100% secure. Whilst we take reasonable measures, we cannot guarantee against unauthorised access, hacking, data loss or other breaches. We encourage users to adopt general good practice, including logging out of your account after use, not sharing your password with others, and changing your password periodically.

6. Children's Privacy

RFD is intended for individuals 18 years and older. We do not knowingly collect or store information from minors.

7. Data Storage and Retention

We want you to be able to access RDF wherever you go in the world. So we may operate a global network of services, including those outside of Australia. The data we store will be held with a third-party data centers but the data is owned by us. We ensure reasonable measures are taken to ensure valid, legal mechanisms are in place to safeguard data privacy.

We also retain data where required to do so under legal or regulatory reasons or the protection of our legitimate business interests. This may include, but is not limited to, situations in which some personal data is kept for tax and accounting purposes in compliance with applicable laws or maintained.
